Terms of Service
The rules for using oscore.net and how our services are governed.
1. Agreement and acceptance
These Terms of Service apply to your use of oscore.net (the "site"), which is operated by OsCore LLC, a Missouri limited liability company ("OsCore", "we", "us"). By using the site you agree to these terms. If you do not agree, please do not use the site.
2. Who may use the site
The site is intended for business and general audiences and is not directed to children under 13.
3. Website use and acceptable use
You may use the site for lawful purposes only. You agree not to:
- attempt to disrupt, probe, overload or circumvent security of the site or its hosting;
- misuse the waitlist form, including automated, repeated or false submissions;
- violate the rights of others or any applicable law.
4. Intellectual property
The site's content, text, design, code and the OsCore name and wordmark belong to OsCore LLC or its licensors. We grant you a limited, revocable, non-exclusive license to view the site for personal or internal business evaluation. Third-party names and marks belong to their respective owners.
5. Client services
Services we perform for clients are governed by a separate written agreement, proposal or statement of work that sets out scope, fees, deliverables, ownership and warranties. If that document conflicts with these terms, the written agreement controls. Information on this site, including pricing examples, is general and is not an offer.
6. OsCore apps on the App Store
Apps that OsCore publishes on the App Store are also subject to Apple's standard Licensed Application End User License Agreement, or to the app's own terms if provided. In general terms: the agreement for an app is between you and OsCore, not Apple; Apple has no obligation to provide maintenance or support for the app; Apple is not responsible for addressing claims relating to the app; and Apple and its subsidiaries are third-party beneficiaries of the app's end user license agreement and may enforce it against you. Billing and subscriptions are processed by Apple. See our Refund Policy.
7. Waitlist
Joining the waitlist is voluntary and free. Joining does not guarantee launch dates, features or access. We may change or end the waitlist at any time. You can ask to be removed at any time by emailing privacy@oscore.net.
8. Third-party links and services
The site may link to or load resources from third parties. We do not control them and are not responsible for their content or practices.
9. Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. INFORMATION ON THE SITE IS GENERAL AND IS NOT A GUARANTEE OF ANY OUTCOME.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OSCORE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO USE OF THE SITE IS LIMITED TO USD 100.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Liability relating to client services is governed by the applicable written agreement.
11. Indemnification
You agree to indemnify and hold OsCore harmless from third-party claims, and related reasonable costs, arising from your misuse of the site or your violation of these terms.
12. Export and sanctions compliance
OsCore complies with applicable United States export control and economic sanctions laws, including programs administered by OFAC. We do not provide services to persons or in countries subject to U.S. sanctions. By using the site you represent that you are not such a person.
13. Governing law and venue
These terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. Any dispute that is not resolved under the next section will be brought exclusively in the state or federal courts located in Missouri, and you consent to personal jurisdiction there.
14. Dispute resolution
Before filing a claim, please send a written description of the issue to legal@oscore.net. We will each try in good faith to resolve it informally for 30 days. If it is not resolved, the courts described in the previous section apply.
15. Changes to these terms
We may update these terms from time to time. The "Last updated" date below shows the current version. Continued use of the site after an update means you accept the updated terms.
16. Termination
We may restrict or end access to the site if you violate these terms.
17. General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These terms, the Privacy Policy and any written client agreement are the entire agreement regarding their subject matter. We may assign these terms in connection with a business transfer.
